Terms of Service
These Terms of Service govern your use of the official hosted SongUp service available at songup.tv. They do not govern the open-source repository or self-hosted versions of SongUp.
By using SongUp, you agree to these Terms.
1. Who operates SongUp

2. What SongUp is
SongUp is a hosted music queue service for parties and shared listening sessions. Hosts can create rooms, display a central player screen, and let guests add songs from YouTube Music to a shared queue.
SongUp is intended for lawful, personal, and business use in accordance with these Terms.
3. Eligibility
You must be at least 16 years old to use SongUp.
If you are under 18, you may only use SongUp if you have permission from a parent or legal guardian and are legally allowed to enter into this agreement under applicable law.
You may not use SongUp if doing so would violate applicable law.
4. Hosted service only
These Terms apply only to the official hosted service at songup.tv.
The public SongUp source code repository and any self-hosted deployment are governed separately, including by the applicable open-source license published in the repository.
5. Accounts and sign-in
Most features of SongUp can be used without creating an account.
Some features, including creating and purchasing Pro rooms, require sign-in with Google. If you sign in, you are responsible for keeping access to your Google account secure and for all activity carried out through your signed-in SongUp account.
6. Rooms and service features
SongUp allows hosts to create rooms and configure features such as:
- fallback playlists,
- queue limits per user,
- guest song submissions,
- host controls, and
- Pro room features.
Room features may change over time as SongUp develops.
Free rooms and Pro rooms may have different limits, retention periods, and available controls.
7. Payments, Pro rooms, and refunds
7.1 Pro rooms
SongUp offers optional paid Pro rooms as a one-time purchase.
A Pro room gives the host access to additional features for that room, such as extended controls.
7.2 Payment providers
Payments are processed by Stripe and/or Link.com (by Stripe). SongUp does not process card payments directly.
SongUp uses Stripe’s Merchant of Record service (through Link.com) - Stripe Managed Payments - to process payments.
By purchasing a Pro room, you also agree to any applicable terms of the payment provider used to complete the transaction.
7.3 When a room is created
A Pro room is created only after successful payment confirmation.
If a payment fails, the room will not be created.
7.4 Refunds
Refunds may be issued for a paid room only if the room was never actually used after creation, meaning that no songs were played and no songs were added other than the fallback playlist.

7.5 No cancellation after creation
Because a room is created immediately after purchase, Pro room purchases cannot be cancelled once the room has been created. This does not limit any mandatory statutory consumer rights.
8. Acceptable use
You may use SongUp only in a lawful and respectful way.
You must not:
- break any law,
- infringe copyrights, trademarks, privacy rights, or other rights,
- use SongUp to harass, threaten, defame, or abuse others,
- submit spam or otherwise misuse the service,
- manipulate queues, limits, or room controls in unauthorized ways,
- interfere with the service, its infrastructure, or other users’ rooms,
- scrape, overload, or attack the service,
- attempt unauthorized access to the hosted service, accounts, rooms, systems, or data,
- use SongUp to distribute illegal, infringing, or otherwise harmful content, or
- use SongUp in a way that violates YouTube’s or Google’s applicable terms.
Hosts are responsible for how they use rooms they create, including who can view or hear content played through SongUp.
9. User content and submissions
SongUp allows users to contribute limited content, including nicknames, search queries, room settings, and song selections.
You keep any rights you may have in content you submit, but you give SongUp a non-exclusive, worldwide, royalty-free license to host, process, transmit, display, and use that content only as needed to operate, secure, improve, and enforce the service.
You represent that you have the necessary rights to submit the content you provide and that doing so does not violate law or third-party rights.
10. Third-party services
SongUp relies on third-party services, including Google, YouTube, Stripe, Link.com, Vercel, Convex, and PostHog.
In particular:
- Google sign-in is used for account access where sign-in is required.
- YouTube and YouTube Music are used for playback, playlist handling, and search-related functionality.
- Payments are handled by Stripe and/or Link.com.
Your use of features powered by third parties may also be subject to those third parties’ terms and privacy notices.
11. Moderation and enforcement
To protect SongUp, its users, and third parties, SongUp may at any time, with or without prior notice where reasonably necessary:
- remove songs, nicknames, playlists, or other submissions,
- suspend or block access to rooms or features,
- refuse or reverse access to paid features where misuse is suspected,
- investigate potential violations of these Terms, and
- take any other action reasonably necessary to enforce these Terms or comply with law.
Reports of abuse, infringement, or violations can be sent to help@songup.tv.
12. Availability and changes
SongUp is provided on an as available basis.
While reasonable care is taken, SongUp does not guarantee uninterrupted availability, error-free operation, or permanent availability of any feature.
Features may be added, changed, limited, or removed at any time.
13. Intellectual property
The SongUp hosted service, including its branding, design, software, text, graphics, and other elements, is protected by applicable intellectual property laws.
Except where permitted by law or by an applicable open-source license, you may not copy, distribute, modify, or exploit protected parts of the hosted service without permission.
14. Disclaimers
SongUp does not own the music or videos that may be surfaced, embedded, or played through the service.
SongUp provides access to queueing and playback workflows built around third-party services. Availability of songs, playlists, search results, embeds, or payment functions may depend on those third-party services.
Nothing in these Terms excludes rights that cannot legally be excluded.
15. Limitation of liability
To the fullest extent permitted by law, SongUp is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities.
Where liability cannot be excluded, SongUp is liable only under mandatory law. In particular, nothing in these Terms excludes liability for intent, gross negligence, personal injury, or any other liability that cannot be excluded under applicable law.
16. Indemnity
You agree to indemnify and hold harmless Matthias Mandler from claims, losses, liabilities, damages, and expenses arising out of your unlawful use of SongUp, your submitted content, or your violation of these Terms, except to the extent such claim was caused by SongUp’s own unlawful conduct.
17. Privacy
The Privacy Policy explains how SongUp processes personal data.
By using SongUp, you acknowledge that your personal data may be processed as described there.
18. Termination
You may stop using SongUp at any time.
SongUp may suspend or terminate your access, in whole or in part, if you violate these Terms, create risk for the service or others, or where suspension or termination is reasonably necessary for legal, technical, or security reasons.
19. Governing law and venue
These Terms are governed by the laws of Austria, excluding conflict-of-law rules to the extent permitted by law.
If you are a business, legal entity under public law, or public-law special fund, the exclusive place of jurisdiction is the competent court at the operator’s seat in Austria.
If you are a consumer, mandatory consumer protection law and mandatory jurisdiction rules remain unaffected.
20. Changes to these Terms
SongUp may update these Terms from time to time.
The version published on songup.tv applies from the time it is made available there, unless a different effective date is stated. Continued use of SongUp after an update takes effect means you accept the updated Terms.
If you do not agree to updated Terms, you must stop using the service.
